FAA Proposes $82,500 Penalty Against French Company for Hazmat Violations

The Federal Aviation Administration, Southern Region, has proposed to assess a $82,500 civil penalty against Imatec S.A. of Perenchies, France, for allegedly violating Department of Transportation hazardous materials regulations. FAA alleges that Imatec improperly offered a fiberboard box containing 24 plastic containers, each of which contained four 100-milliliter glass flasks of sulfuric acid, which is a corrosive. The package was transported, via regularly scheduled UPS cargo flights from Paris, France through several cities in the United States and the Caribbean. It was transported via a British West Indies International Airways passenger flight from Trinidad to Miami International Airport, where it was discovered by the U.S. Customs Service during a routine inspection. Imatec offered the hazardous materials for transportation when they were not properly packaged, labeled, marked, classed, described, documented, or in condition for shipment as required by regulations. Imatec also failed to ensure employees were trained to properly package and handle hazardous materials, and did not make emergency response information immediately available for use at all times hazardous materials were present. Imatec has 30 days from receipt of the FAA notice to submit a reply to the agency.

This announcement is made in accordance with the FAA's practice of releasing information to the public on newly issued enforcement actions involving penalties of $50,000 or more.
