FAA Proposes $72,000 Penalty Against Luxembourg Company for Hazmat Violations

The Federal Aviation Administration, Southern Region, has proposed to assess a $72,000 civil penalty against International Lacquers, S.A. of Bettenbourg, Luxembourg for allegedly violating Department of Transportation hazardous materials regulations.

FAA alleges that International Lacquers improperly offered a fiberboard box containing 122 bottles of nail polish (a total of three gallons) to United Parcel Service for transportation by air. Nail polish is a flammable liquid.

The shipment was discovered when ground handling employees at the UPS sort facility in Miami noticed a strong odor from the box. International Lacquers offered the hazardous materials for transportation even though they were not packaged, labeled, marked, classed, described, documented, nor in condition for shipment as required by regulations. International Lacquers also failed to ensure employees were trained to package and handle hazardous materials properly, and did not make available at all times the required emergency response information. International Lacquers has 30 days from receipt of the FAA notice to reply to the agency.

This announcement is made in accordance with the FAA's practice of releasing information to the public on enforcement actions involving penalties of $50,000 or more.
