FAA Proposes $133,000 Civil Penalty for Company Attempting to Ship Hazardous Materials Aboard Aircraft

FORT WORTH --

The Federal Aviation Administration has proposed to assess a $133,000 civil penalty against an Oklahoma cosmetics manufacturing company for allegedly violating Department of Transportation hazardous materials regulations.

The FAA alleged that Cosmetic Specialty Labs, Inc., of Lawton, Okla., offered Fritz Air Freight, an indirect air carrier, 21 boxes of hair styling spray for transportation by air from Dallas/Fort Worth International Airport to Oslo, Norway. The shipment consisted of one box containing 46 bottles and 20 boxes each containing 72 bottles of styling spray. The hazardous material has a flashpoint of 55 degrees Fahrenheit. Customs agents discovered the spray at Dallas/Fort Worth and called FAA inspectors. The spray is classified as denatured alcohol, a flammable liquid. In addition, Cosmetic Specialty Labs failed to ensure that each of its Hazmat employees were properly trained and failed to make emergency response information immediately available for use at all times the hazardous materials were present.

FAA said Cosmetic Specialty Labs offered the hazardous materials for transportation by air when the material was not properly classed, described, packaged, marked, labeled or in a condition for shipment as required under the regulations. The size of the shipment also exceeded the hazardous material quantity limits for transportation on passenger aircraft. The company has 30 days from receipt of the enforcement letter to respond to the agency.

Announcement of the proposed civil penalty is made in accordance with FAA's policy of releasing information to the public on newly issued enforcement actions in cases that involve penalties of $50,000 or more.
