FAA Proposes Civil Penalties Against Cummins Engine Co., Inc., for Hazmat Violations

The Federal Aviation Administration, Southern Region, has
proposed to assess civil penalties totaling $289,000 against
Cummins Engine Co., Inc. for allegedly violating Department of
Transportation hazardous materials regulations on five separate
occasions.

In five separate cases, the FAA alleges that several different
Cummins offices improperly offered fiberboard boxes containing
diesel fuel pumps and other mechanical parts and machinery
containing or coated with diesel fuel, a flammable liquid, to UPS
for transportation by air. In each case, ground handling employees
at the UPS sort facility in Louisville, Ky., discovered the
shipments leaking.

A civil penalty of $51,000 has been proposed against Cummins
Eastern Canada, Dartmouth, Nova Scotia. Civil penalties of
$59,500 each have been proposed against Cummins Atlantic, Inc.,
Charlotte, N.C. and Cummins Northwest, Inc., Renton Wash. Two
$59,500 civil penalties have been proposed against the
headquarters of Cummins Engine Co., Inc., Columbus, Ind.

Cummins offered the hazardous materials for transportation when
they were not packaged, labeled, marked, classed, described,
documented, or in condition for shipment as required by
regulations. Cummins also failed to ensure employees were
trained to properly package and handle hazardous materials, and
did not make available at all times the required emergency
response information.

Cummins has 30 days from receipt of the FAA notice to submit a
reply to the agency. This announcement is made in accordance
with the FAA's practice of releasing information to the public on
newly issued enforcement actions involving penalties of $50,000
or more.
